APPENDIX 4: ASSIGNMENT AGREEMENT BETWEEN THE EUROPEAN COMMISSION AND IRELAND REGARDING COPYRIGHT
IN THE COMMON FACE OF EURO COINS
ASSIGNMENT OF COPYRIGHT IN THE DESIGNS OF THE COMMON FACE
OF THE EURO COINS

THE EUROPEAN COMMUNITY (hereinafter "The Community")
represented by
THE COMMISSION OF THE EUROPEAN COMMUNITIES
(hereinafter "The Commission")
to IRELAND
Represented by the Minister for Finance of Ireland
Whereas the Treaty on European Union laid down the rules for the adoption of a single currency for the Union;
Whereas Article 106(2) of the Treaty establishing the European Community provides that the Member States may issue the relevant coins;
Whereas a competition for the design of the common face of the coins was held in all Member States (with the exception of Denmark) starting in the second half of 1996 and ending in June 1997 with the designation of the winning designs by the European Council;
Whereas the author of the winning designs transferred his copyright therein to the Community;
Whereas it is appropriate that each Member State participating in the single currency should become the owner of the copyright in the designs for the common face of the coins as regards its own territory;
Whereas each Member State will apply its national law concerning copyright;
Whereas it has been agreed that the copyright will be exercised in a certain way,
THEREFORE
THE COMMUNITY HEREBY ASSIGNS TO THE MINISTER FOR FINANCE OF
IRELAND ALL RIGHTS WHATSOEVER HELD BY THE COMMUNITY
ENTITLING IT TO CLAIM COPYRIGHT IN THE TERRITORY OF IRELAND
AS REGARDS THE DESIGNS OF THE COMMON FACE OF THE EURO COINS
IN CONSIDERATION WHEREOF THE MINISTER FOR FINANCE OF IRELAND SOLEMNLY UNDERTAKES
To permit the following types of reproduction of the designs:
- reproduction in the form of photographs, drawings, paintings, films, images, and generally reproductions in flat format (without relief) provided they are in faithful likeness and are used in ways which do not damage the image of the euro;
- reproduction with relief on objects other than coins, medals and tokens or any other objects which might be confused with coins;
- reproduction on tokens made of soft material (such as chocolate) or made in plastic provided the size is at least fifty per cent greater or smaller than the real coins
and not to permit
subject to the prerogatives of the entity duly authorised by the Minister for Finance of Ireland to mint coins on its territory,
-
reproduction on medals and tokens made in metal or on any other object made in metal which might be confused with coins.
This contract shall be governed by the law of Ireland. It shall have a duration equivalent to the period during which the designs are used as the common face of the euro coins.
